General Terms and Conditions (GTC) for the use of the website of Connoisseur Circle Reiseservice GesmbH (hereinafter referred to as CC), 1070 Vienna, Mariahilfer Straße 88a/2/2a

A) FOR ALL

  1. VALIDITY

    The present website www.ccircle.cc is an offer of CC.

    For all transactions between the respective customer/user/provider (hereinafter also referred to as User), these GTCs shall apply exclusively. Conflicting terms and conditions of the User shall only be effective if expressly accepted by CC in writing. Agreements deviating from or supplementing these GTCs must be made in writing. Should individual provisions of these GTCs be invalid, this shall not affect the binding nature of the remaining provisions and the contracts concluded on the basis thereof. The invalid provision shall be replaced by a valid provision that comes closest to its meaning and purpose.

    By establishing a connection to the website and by any other use of the offers or services on this and other websites of CC, the respective user (hereinafter referred to as User) accepts the present General Terms and Conditions (GTCs) as binding and submits to them. In addition to these GTCs, the user also accepts the binding nature of the Netiquette.

    Paying users also accept the GTCs extended by section B.

    By using the offers of CC, the User confirms to be at least 18 years of age and fully legally competent and - if required - to have the consent of the respective connection owner or contractual partner of the telecommunication services or to have the consent of his/her legal guardian to use the services.

  2. OFFER

    CC is an information and communication platform for luxury travelers and strives to provide these services in the best quality. However, the User has no claim or guarantee regarding the availability, freedom from defects, reliability or functionality of the services offered.

    CC reserves the right to change, discontinue or restrict these services - also to certain user groups - even without prior notice. In particular, CC reserves the right to offer free content at a later date only against payment. Users may be temporarily or permanently excluded from the use of individual or all services - even without giving reasons.

    There is no claim to continued operation or use of the services of CC.

  3. LIABILITY

    The user acknowledges that any warranty and liability of CC towards users, especially for damages resulting from the use of the services and the programs offered for download - as far as legally permissible - is excluded. Furthermore, claims for damages by the user or third parties due to the use or even only the unavailability of CC's services are excluded.

    In particular, CC cannot accept any liability for freedom from viruses and other harmful programs such as spyware, Trojans and similar and recommends that the user install suitable protection programs, in particular virus protection software and regularly update such programs.

    CC shall not be liable for the contents of third parties, even if these are referred to by means of links, or for the functionality of data and programs offered for download, or for any damage resulting from the use of these programs, unless such damage was caused by intent or gross negligence on the part of CC itself.

    CC shall not be liable for any infringements of rights or misconduct committed by users of the offers or services of CC or for contents created and/or distributed by users.

    In the event of a violation of these General Terms and Conditions, the user undertakes to reimburse CC for the costs of locating, determining the extent of and remedying any damage or to indemnify and hold CC harmless.

  4. USER BEHAVIOR

    When using the offers of the CC, the user is solely responsible for compliance with all relevant laws and regulations as well as for the protection of the rights of third parties. By using the offers and services of CC, the user undertakes not to misuse them for illegal purposes. In particular, the user is liable for all data sent to CC and undertakes to refrain from sending data that contains illegal, immoral, morally offensive, pornographic or otherwise questionable content or that could cause damage or harass other users. This cease and desist obligation also includes, in particular, violations of competition law regulations, personal rights, trademark rights, copyrights and other proprietary rights of third parties.

    Links from and to CC's website must not infringe any third party rights. Links to the website must be external links and must reproduce entire pages (including navigation frames). A transfer into own frames is not permitted. If users create links to other websites, CC does not assume any responsibility, neither for the content (e.g. against legal regulations or morality violating, incorrect or incomplete content) of these websites nor for damages resulting from the use of linked information.

    In particular, the user undertakes to refrain from disturbances, interruptions or changes to the offers of CC and to indemnify and hold CC harmless for all disadvantages and damages arising from the violation of these GTCs - also in the case of claims by third parties.

    The User undertakes to protect his password and not to pass it on to third parties. In the event that the password becomes known to third parties, the user undertakes to change it immediately. In the event of disclosure or other misuse - in particular due to insufficient protection - the User shall be liable for all consequences and shall also indemnify and hold CC harmless against third parties.

  5. TRANSACTIONS WITH THIRD PARTIES

    Transactions concluded between Users via the CC platform, in particular via the Users' respective websites, shall be exclusively between the respective Users, i.e. between the provider of the respective goods, services or performances and the accepting party. Any liability whatsoever of CC, in particular for the correctness of the information provided by the respective users about their offers of goods, services or performances, the seriousness or creditworthiness of the users or the fulfillment of the concluded contracts, is excluded.

  6. SCOPE OF USE

    The offers or services of CC may only be used for private purposes without their express written consent to the contrary. Data and content may also be passed on exclusively for private purposes. Any commercial use, in particular also advertising, is excluded without the express written consent of the CC.

    When passing on content for CC services or using it, the user guarantees that he/she has all the necessary rights, in particular exploitation rights and copyrights, also for the Internet.

    CC is not obligated - but is entitled in each individual case - to monitor the services in general or the use by one or more specific users. Each user expressly grants CC the right to record all data necessary for tracing, such as in particular date, time and IP address, and to evaluate these in particular in the event of misuse.

  7. CHANGES

    Agreements with the CC and termination of registrations must also be confirmed by the user in writing (by email, fax or post), whereby this written form requirement can only be waived by separate written agreement.

    Changes to these GTCs on the part of CC are possible at any time without prior notice. They shall be published on www.ccircle.cc and shall become binding - unless expressly provided otherwise - on the first day following publication. The users will be informed of such changes by email.

  8. LAW AND JURISDICTION

    The legal relationship between CC and the User shall be governed exclusively by Austrian law, to the exclusion of its conflict-of-law rules, unless otherwise provided by mandatory provisions of Austrian law.

    The exclusive place of jurisdiction for all disputes arising from and in connection with the services of CC shall be the competent court in Vienna, unless mandatory provisions, such as the Consumer Protection Act (hereinafter referred to as KSchG), conflict with this. However, CC may also claim the general place of jurisdiction of the User.

  9. PROPERTY RIGHTS

    The services, the contents offered by CC are primarily protected by copyright. Any reproduction, distribution or other use is only permitted within the expressly authorized framework (see point 6)).
